Terms of Service

Effective September 11, 2026

1. Acceptance of These Terms

These Terms of Service (“Terms”) govern access to and use of Missed2Lead, including missed-call follow-up, messaging, lead-management, automation, AI-assisted features, dashboards, websites, pilot programs, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of a business or organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

Missed2Lead is designed to help businesses respond to missed calls, communicate with prospective customers, organize lead information, and assist with follow-up. Features may include call routing, automated text messages, two-way messaging, lead statuses, notifications, AI-generated summaries, urgency classifications, extracted customer details, and automated replies.

Features may change, be added, or be removed as the product evolves, particularly during beta or pilot testing.

3. Pilot and Beta Services

Early-access, pilot, or beta versions may contain errors, interruptions, incomplete features, or functionality that changes without notice. Pilot access does not guarantee future availability, pricing, features, or commercial launch.

You should maintain appropriate backup communication procedures and should not rely on a pilot version of Missed2Lead as the sole way to receive urgent or time-sensitive customer communications.

4. Business Customer Responsibilities

Businesses using Missed2Lead are responsible for:

  • Providing accurate business, phone, messaging, and account information.
  • Obtaining and maintaining any consent legally required before calling or messaging an end user.
  • Providing required disclosures, privacy notices, and opt-out methods.
  • Complying with applicable telecommunications, privacy, consumer-protection, marketing, and industry rules.
  • Reviewing lead information and automated outputs before relying on them for important decisions.
  • Maintaining appropriate human staffing and escalation procedures.

You may not use Missed2Lead to send unlawful spam, deceptive communications, prohibited content, or messages to people who have not provided any consent required by law or carrier rules.

5. SMS Messaging Terms

When the built-in Missed2Lead missed-call text flow is used, an unanswered caller is presented with a voice disclosure asking whether they want to receive a text about their request. The caller must press 1 before the first missed-call SMS is sent. Missed2Lead records that consent event. If the caller does not press 1, the built-in missed-call flow does not send the SMS.

Message frequency varies depending on the customer interaction. Message and data rates may apply.

To stop receiving messages from a particular messaging program, reply STOP to the number from which you received the message. For assistance, reply HELP. Consent to receive SMS messages is not a condition of purchase unless otherwise clearly stated and legally permitted.

Wireless carriers are not liable for delayed or undelivered messages. Message delivery is not guaranteed and may be affected by carrier filtering, outages, device settings, number registration, network conditions, or third-party services.

Mobile phone numbers, SMS opt-in information, and messaging consent are not sold or shared with third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy for more information.

6. AI and Automated Features

Missed2Lead may use automated or AI-assisted systems to summarize conversations, extract customer details, rank lead priority, suggest actions, and generate or send responses when configured to do so.

AI outputs may be inaccurate, incomplete, or inappropriate for a particular situation. Missed2Lead does not guarantee the accuracy of summaries, classifications, extracted information, suggested actions, or generated messages. Businesses remain responsible for reviewing important information and making final business, safety, scheduling, pricing, and service decisions.

Missed2Lead is not an emergency service, medical provider, law firm, financial adviser, or other professional service. Do not rely on the Service to replace emergency services or professional judgment.

7. Accounts and Security

You are responsible for safeguarding login credentials, API keys, passwords, and devices used to access the Service. You must notify us promptly if you believe an account or credential has been compromised.

8. Customer Data

As between Missed2Lead and a business customer, the business customer retains its rights in data that it or its end users submit to the Service, subject to rights necessary for Missed2Lead to host, transmit, process, analyze, secure, and otherwise provide the Service.

You represent that you have the rights and permissions necessary for information you submit or instruct Missed2Lead to process.

9. Third-Party Services

The Service may depend on third-party communications, hosting, database, AI, payment, domain, form, or infrastructure providers. Missed2Lead is not responsible for outages, restrictions, delays, or failures caused by third-party services outside our reasonable control.

10. Acceptable Use

You may not use the Service to:

  • Violate any law, regulation, carrier rule, or third-party right.
  • Send unsolicited or deceptive messages.
  • Harass, threaten, defraud, impersonate, or mislead others.
  • Transmit malware or interfere with the security or operation of the Service.
  • Attempt to access accounts, systems, or data without authorization.
  • Use the Service for illegal or prohibited goods, services, or activities.

11. Fees

Pilot access may be offered without charge or under separately communicated terms. If paid plans are introduced, pricing, billing intervals, usage charges, taxes, cancellation terms, and any applicable refund rules will be disclosed before purchase.

12. Intellectual Property

Missed2Lead and its software, branding, interfaces, designs, and related materials are owned by Missed2Lead or its licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of the Service to you.

13. Suspension and Termination

We may suspend or terminate access to the Service when reasonably necessary to address misuse, security risk, legal or carrier requirements, nonpayment, violation of these Terms, or threats to the Service or other users. You may stop using the Service at any time.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR GUARANTEED TO RECOVER, CONVERT, OR BOOK ANY PARTICULAR LEAD OR CUSTOMER.

15. Limitation of Liability

To the maximum extent permitted by law, Missed2Lead will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, customers, data, goodwill, or business opportunities arising from or related to the Service.

Any additional limitations applicable to paid plans may be included in the applicable order, subscription, or customer agreement.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles, except where applicable law requires otherwise.

17. Changes to These Terms

We may update these Terms as the Service evolves. Updated Terms will be posted on this page with a revised effective date. Continued use after an update constitutes acceptance where permitted by law.
